Defective Products
In many instances when someone or something is damaged by a defective, faulty or dangerous product, it turns out that there are many similar incidents involving the same product. In fact, most product recalls over the last five years have involved class actions in which a class of individuals (insureds) sued the manufacturer, distributor or retailer of the defective product. When these products cause fire or water damage to property, or result in appliances that do not work properly and have to be replaced, it is often advantageous to bring these actions together in one lawsuit. This offers a number of advantages, including lower litigation costs, larger recoveries and consistent results. Although not every case is appropriate for a class action, many product liability cases are uniquely suited to this form of litigation since the product affects a large number of consumers or insureds. Class action product liability litigation can involve virtually any type of product including, for example, power tools, wall-mounted or free-standing propane heaters, gas regulators, propane tanks, and even toys. CPR has unique access to the types of experts that are required to analyze a product, determine if a defect exists, and find an appropriate solution. CPR also has the experience and the expertise to efficiently pursue these types of cases and obtain a fair recovery in the event of litigation.
